Why are MLMs legal? MLMs are legal because they operate as a legitimate form of direct selling. Companies sell real products through independent distributors, and commissions are paid based on product sales volume. This structure is recognized as a legal business model in the United States, the EU, and most other countries.

**The Legal Framework**

The FTC distinguishes between legal MLM and illegal pyramid schemes based on one key factor: where the money comes from. If a company’s revenue is generated primarily by selling products to end consumers, it is a legal MLM. If revenue comes primarily from recruitment fees or mandatory purchases by new distributors, it is a pyramid scheme.

Why are MLM legal despite the criticism? Because the business model itself is sound — it is simply a distribution method. The problems arise when individual companies misuse the model to prioritize recruitment over sales. Regulators address this on a company-by-company basis rather than banning the entire model.
