# Is It an MLM?

**Updated:** April 2026

Is it an MLM? If you are trying to determine whether a specific company or opportunity is an MLM, there are clear signs to look for. An MLM (multi-level marketing) company has a distinct structure that separates it from traditional businesses, affiliate programs, and franchises.

**How to Tell**

* You are asked to buy a starter kit or product inventory to join
* You earn commissions not only from your sales but also from the sales of people you recruit
* There is a multi-level compensation plan with terms like “upline,” “downline,” “levels,” and “ranks”
* You are encouraged to recruit others as part of the business opportunity
* The company distributes products through independent representatives, not retail stores

If a business has these characteristics, it is an MLM. That does not automatically mean it is bad or illegal — but it does mean you should evaluate the product, compensation plan, and income disclosure before joining.

**Definition:** You can identify an MLM by its multi-level commission structure, starter kit purchases, emphasis on recruitment, and distribution through independent representatives rather than traditional retail.

Not every MLM is a scam, but every MLM requires scrutiny. Check the product demand, the compensation plan, and the income disclosure data before committing.
